SCRATCHEE.COM MASTER INSTANT WIN GAME RULES

NO PURCHASE OR PAYMENT OF MONEY IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF MONEY WILL NOT IMPROVE THE CHANCES OF WINNING.

APPLICATION OF THESE MASTER RULES: These Rules, known as the “Scrachee.com Master Instant Win Game Rules” or “Master Rules” shall apply to any prize promotion conducted by DGR Media (“Sponsor”) on the website www.scratchee.com (the “Website”) that is played by the application of a Scratchee Card or similar device and that specifically refers to these Master Rules (a “Game”). Sponsor reserves the right to modify or amend these Master Rules at any time. Each Game will have a separate Game Rules for that Game which will disclose material terms specific to that Game and which will be subject to these Master Rules. In the event of a conflict between any Game Rules and these Master Rules, the Game Rules for that Game will apply. For each Game, these Master Rules and the applicable Game Rules shall be collectively referred to as the “Official Rules” for that Game.

ELIGIBILITY: Games are open only to legal residents of the applicable 50 United States of America (excluding residents of Florida, Georgia, Maine, Michigan, and New York), and the District of Columbia who are at least eighteen (18) years of age or have reached the age of majority in their respective state of residence at the time of entry, whichever is older. Employees, officers, directors, members, and agents of Sponsor, its parent companies, subsidiaries, affiliates, and their distributors, sales representatives and advertising and promotional agencies, (collectively, the “Released Parties”), and members of their immediate families (defined as including spouse, biological, adoptive and step-parents, grandparents, siblings, children and grandchildren, and each of their respective spouses, regardless of where they reside) or households (whether related or not) of any of the above are NOT eligible to participate in a Game. Non-eligibility or non-compliance with any of the Official Rules will result in disqualification. Void in FL, GA, ME, MI and NY and where prohibited or restricted by law.

AGREEMENT TO OFFICIAL RULES: By participating in a Game, you agree to abide by and be bound by the Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Game. Winning a prize is subject to validation and contingent upon fulfilling all requirements set forth in the Official Rules.

ENTRY PERIODS: The start and end dates and times of a Game shall be listed in the applicable Game Rules (each an “Entry Period”). Unless otherwise specified in the Game Rules, each Game will end on the earlier of the end date and time listed in the Game Rules or when all Scratchee Cards available for that Game have been distributed, whichever is earlier.   The Sponsor’s database computer is the official timekeeping device for a Game.

HOW TO PLAY: In order to play a Game, you will need to have an online account (your “Account”) at the Website. You can obtain an account for free by going to the Website and providing the information requested. Your Account is subject to the Terms of Service of the Website All information submitted will be treated according to Sponsor’s Privacy Policy, available at https://help.scratchee.com/privacy-policy.

Once you have created an Account, you can play a Game by obtaining virtual Instant Win scratch cards (a “Scratchee Card”) in one of two ways:

  • Purchase access to the products and services available on the Website.  The specific products / services and Scratchee Cards available will be disclosed on the Website.
  • Mail a 4” x 6” postcard with proper postage to: ASC/DGR Media, Game Piece Request, 377 Valley Road 1414, Clifton, NJ 07013, including on the postcard in handwriting your full name, street address, date of birth and email address, the specific Game by game ID for which you want a Scratchee Card and include a minimum unique 20 word description of why you enjoy playing Scratchees. Limit one (1) request per person per postcard. Typed, photocopied, or mechanically reproduced entries will not be accepted. All requests must be postmarked by the end date of the Game and received within 5 days of that end date. Once your request is received, you will receive one (1) Scratchee Card for the Game requested per request via email. It is important to mark scratchee.com as a safe sender domain assist the email not going to spam.  

There are a discrete number of Scratchee Cards available for a Game, and the Entry Period will end once all Scratchee Cards for that Game have been distributed.

GAME PLAY: Go to the Website, sign in to your Account, navigate to your ‘My Scratchees’ and select ‘Start Scratching’ to play. Virtually scratch the Scratchee Card and an immediate onscreen message will notify you whether you are a potential winner of a prize in the applicable Game. Scratchee Cards for a particular Game must be played within five days of the end date of that Game. Any Unplayed Scratchees after these periods will be void and not eligible to be played in the Game or to win a prize in the Game.

VALIDATION: You are not a winner of a prize unless and until you are validated and have received official notification that validation is complete from Sponsor. Potential prize winners may be required to complete and sign an Affidavit/Declaration of Eligibility and a Prize/Publicity Release (where lawful) within the time requested by Sponsor. Prize winners may also be required to sign and return completed tax forms to Sponsor upon request. Failure to return these documents within the time requested will result in forfeiture of any prize.

PRIZES/ODDS OF WINNING: The number and value, and any other specific prize details, for prizes available in a Game and the odds of winning a prize will be disclosed in the Game Rules. All amounts are listed in U.S. dollars. All expenses and taxes associated with the prize are the responsibility of the Winners. No substitution or transfer of a prize will be permitted, except by the Sponsor, who reserves the right at its sole discretion to substitute a prize with another prize of equal or greater value. Once you have been validated as an official prize winner, the prize will be credited in your Account. Prize redemption instructions will be provided in your Account.

GENERAL CONDITIONS: Only the number and value of prizes as stated in the Game Rules are available to be awarded in that Game. Any unclaimed prizes will not be awarded. If due to printing, electronic or other error, there are more claims for any particular prize(s) than available as stated in the Game Rules, these prizes will be awarded by random drawing from among all potential claimants with valid claims for that prize(s).   If for any reason the operation or administration of a Game is impaired or incapable of running as planned for any reason, including but not limited to (i) infection by computer virus, bugs, (ii) tampering, unauthorized intervention, (iii) fraud, (iv) technical failures, or (v) any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Game, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Game in whole or in part, at any time, without notice and award the available prizes using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable and best conforms to the spirit of these Official Rules. Sponsor reserves the right, at its sole discretion, to disqualify any individual deemed to be tampering or attempting to tamper with the entry process or the operation of a Game or Sponsor’s Websites; or acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE; THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event of a dispute as to the identity of an entrant or winner, the entrant will be declared by the authorized account holder of the email address associated with Account. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

RELEASE AND LIMITATIONS OF LIABILITY: By participating in a Game and/or accepting any prize, you agree to release and hold harmless the Released Parties from and against any claim or cause of action arising out of participation in the Game or receipt or use of any prize, including, but not limited to: (i) any technical errors that may prevent you from playing the Game or using or accessing a Scratchee Card; (ii) unauthorized human intervention in the Game; (iii) printing errors; (iv) errors in the administration of the Game or the processing of entries; or (v) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the Game or receipt of any prize. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to your or any other person's computer or phone relating to or resulting from participation in this Game or downloading any materials related to the Game or your Account.   You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Game, and in no event shall the Released Parties be liable for attorney fees. You hereby waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. For New Jersey Residents: nothing herein bars recovery of damages or attorneys’ fees where mandated by statute.

Except as expressly provided above, IN NO EVENT WILL RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS GAME OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF A PRIZE.

EACH ENTRANT UNDERSTANDS AND AGREES THAT ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY OF THE USA ARE HEREBY EXPRESSLY WAIVED BY HIM/HER. SECTION 1542 READS AS FOLLOWS:

“A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”

DISPUTES: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants and Sponsor in connection with a Game shall be governed by and construed in accordance with the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s, province’s, or jurisdiction’s laws. By participating in a Game, you agree that: (i) any and all disputes, claims, and causes of action arising out of or in connection with the Game, shall be resolved individually without resort to any form of class action; (ii) any judicial proceeding shall take place in a court within the State of New Jersey; (iii) any and all claims, judgments , and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Game, but in no event will attorney fees be awarded or recoverable; (iv) under no circumstances will you be permitted to obtain awards for, and you hereby waives all rights to seek, punitive, incidental, exemplary, consequential, special damages, lost profit s, other damages, and/or any rights to have damages multiplied or otherwise increased; and (v) your remedies are limited to a claim for money damages (if any) as stated above, and you waive any right to seek injunctive or equitable relief.

SEVERABILITY: The invalidity or unenforceability of any provision of the Official Rules will not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, the other provisions will remain in effect and will be construed as if the invalid or unenforceable provision were not contained herein.

MISCELLANEOUS: The Official Rules contain the full and complete understanding with respect to the Game and supersede all prior and contemporaneous agreements, representations, and understandings, whether oral or written. The headings herein are for convenience only, do not constitute a part of the Official Rules, and shall not be deemed to limit or affect any of the provisions hereof. No amendment to, or waiver of, any provision of the Official Rules shall be effective unless in writing and signed by Sponsor. The waiver by Sponsor of any provision of the Official Rules shall not constitute a waiver of any other provision herein. The rights and obligations hereunder may not be assigned by you, whether by operation of law or otherwise, without the prior written consent of Sponsor, and any attempted assignment in violation of the foregoing shall be null and void. The Official Rules shall be binding upon, and inure to the benefit of, the permitted successors and assigns of Sponsor and entrants.

WINNERS LIST REQUEST: To request confirmation of the first name, last initial, city, and state of residence of a Winner of any major prize in a Game, please send a self-addressed, stamped business size envelope, by the end date of that Game to DGR Media LLC, 377 Valley Road 1414, Clifton, NJ 07013, including identification of the specific Game.
