SCRATCHEE.COM MASTER INSTANT WIN GAME RULES
NO PURCHASE OR PAYMENT OF MONEY IS NECESSARY TO PARTICIPATE. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT IMPROVE THE CHANCES OF WINNING. YOU HAVE NOT WON.
These Rules, known as the “Scrachee.com Master Instant Win Game Rules”, “Master Rules”, or “Rules” shall apply to any prize promotion conducted by DGR Media (“Sponsor”) on the website www.scratchee.com (the “Website”) that is played by the application of a Scratchee Card or similar device which may award real prizes, and that specifically refers to these Master Rules (a “Game”). Sponsor reserves the right to modify or amend these Master Rules at any time. Each Game will have a separate Game Details (“Details”) for that Game which will disclose material terms specific to that Game and which will be subject to these Master Rules. In the event of a conflict between any Game Details and these Master Rules, the Game Details for that Game will apply. For each Game, these Master Rules and the applicable Game Details shall be collectively referred to as the “Official Rules” for that Game. These Rules are to be read in conjunction with our Terms of Service (“Terms”) link. Words and phrases which are defined in the Terms have the same meaning in these Rules.
NOTE THAT THESE MASTER RULES INCORPORATE SECTION 17 OF THE TERMS, WHICH INCLUDE A PROVISION WAIVING THE RIGHT TO PURSUE ANY CLASS, GROUP, OR REPRESENTATIVE CLAIM AND REQUIRING YOU TO PURSUE PAST, PENDING, AND FUTURE DISPUTES BETWEEN YOU AND US THROUGH INDIVIDUAL ARBITRATION UNLESS YOU OPT OUT WITHIN THE SPECIFIED TIME FRAME.
ELIGIBILITY:
Games are open only to legal residents of the applicable 50 United States of America (excluding residents of Florida, Louisiana, Michigan, Montana, Nevada, New Jersey, New York, and Washington), and the District of Columbia who are at least eighteen (18) years of age or have reached the age of majority in their respective state of residence at the time of entry, whichever is older.
A person who participants in the Games is shall be referred to as a “Participant”.
The Games are subject to all applicable federal, state, provincial, territorial, and local laws and regulations. It is the sole responsibility of a Participant to determine whether the Game is legal and compliant with all regulations in the jurisdiction in which the Participant resides.
Employees, officers, directors, members, and agents of Sponsor, its parent companies, subsidiaries, affiliates, and their distributors, sales representatives and advertising and promotional agencies, (collectively, the “Released Parties”), and members of their immediate families (defined as including spouse, biological, adoptive and step-parents, grandparents, siblings, children and grandchildren, and each of their respective spouses, regardless of where they reside) or households (whether related or not) of any of the above are NOT eligible to participate in a Game.
Non-eligibility or non-compliance with any of the Official Rules will result in disqualification.
Void in FL, LA, MI, MT, NV, NJ, NY, WA and where prohibited or restricted by law.
AGREEMENT TO OFFICIAL RULES: By participating in a Game, you agree to abide by and be bound by the Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Game. Winning a prize is subject to validation and contingent upon fulfilling all requirements set forth in the Official Rules.
ENTRY PERIODS: The start and end dates and times of a Game shall be listed in the applicable Game Details (each an “Entry Period”). Unless otherwise specified in the Details, each Game will end on the earlier of the end date and time listed in the Game Details or when all Scratchee Cards available for that Game have been distributed, whichever is earlier. The Sponsor’s database computer is the official timekeeping device for a Game.
HOW TO PLAY:
In order to play a Game, you will need to have an active Scratchee Account. You can obtain an Account for free by going to the Website and providing the information requested including a user’s full name residential address, email, and phone number. To participate in a Game, a Participant must access the Website and sign into their Account. Your Account is subject to the Terms of Service of the Website. All information submitted will be treated according to Sponsor’s Privacy Policy, available at https://help.scratchee.com/privacy-policy.
Once you have accessed the Website and created an Account, you can play a Game in the United States (including the District of Columbia but excluded outlying territories and the States of Florida, Louisiana, Michigan, Montana, Nevada, New Jersey, New York, and Washington) by obtaining virtual Instant Win scratch cards (a “Scratchee Card”) in one of two ways:
- Purchase access to the products and services available on the Website. Certain discount hub products / services available for sale of the Website include as a bonus certain Scratchee Cards. The specific Scratchee Card a Participant will receive as a bonus for each relevant purchase will be stated in the Website purchase window. All purchases of product/services are final, and no refunds will be given. It is not possible to only purchase Scratchee Cards, they can only be obtained as a bonus via a product/service promotional package, and through the other method as stated below.
- Receive a Scratchee Card of your choosing by sending a request by mail. Participants can receive any Scratchee Card of their choosing by accessing and generating a code via the Get Mail-In Code button here or in the footer of the website, which requires following the prompts to generate and reveal a 13 character unique code (the “Postal Request Code”). The information that must be provided to generate a Postal Request Code includes the Game’s Unique Game ID which is found in its Game Details and agreeing to the Terms of Service and the Official Rules. New codes can be generated approximately every 10 minutes.
Participants must then send a standard post card or piece of paper (“Request Card”) which must be 4” x 6” , white, unfolded, blank, unlined, and placed inside a stamped standard #10 white addressed envelope with proper postage to the following address and satisfying the requirements set out below:

Participants must then
- Write the words “Sweepstakes Entry” with the applicable Game ID on the top left corner of the envelope in addition to their return address in blue or black ink. (For the avoidance of doubt, this should read as follows: Sweepstakes Entry – Game ID ######); and
- Write in blue or black ink all of the follow on only one side of the Request Card inserted inside the envelope:
- Their full name as shown on their government issued identification;
- The email address registered to their Account;
- The residential address registered to their Account;
- The unique Postal Request Code; and
- The following statement:
“I wish to receive a Scratchee Card to participate in the sweepstakes promotions offered by Scratchee.com. By submitting this request, I hereby declare that I have read, understood, and agree to be bound by Scratchee.com’s Official Rules and Terms of Service.”
For each Request Card a Participant submits in accordance with the above requirements, the Participant will receive via email one (1) Scratchee Card for the specific Game ID requested. It is important to mark scratchee.com as a safe sender domain assist the email not going to spam. NOTE: A Participant must ensure that their handwriting is legible. If the Participants handwriting is not legible, the entry will be void and the Scratchee Card will not be provided to the Participant. The legibility of a Participant’s handwriting shall be determined by the Sponsor/Promoter in its sole discretion. Typed, photocopied, or mechanically reproduced entries will not be accepted. Requests made by any other individual or any entity (including but not limited to commercial sweepstakes subscription notification and/or entering services) or posted from a State or Province different to the Participant’s verified residential address will be declared invalid and the Scratchee Card will not be provided. Tampering with the entry process or the operation of the Games, including but not limited to the use of any device to automate the Scratchee Card request/entry process, is prohibited and any requests/entries deemed by Sponsor/Promoter, in its sole discretion, to have been submitted in this manner will be void. In the event a dispute regarding the identity of the individual who actually submitted a request or whether a request satisfies the requirements set out above cannot be resolved to Sponsor/Promoter’s satisfaction, the affected request/entry will be deemed ineligible.
There is a limit of one (1) request per person per outer envelope. For the avoidance of doubt, combined requests sent via package or parcel do not meet the requirements set out above and are invalid.
All requests must be postmarked by the end date of the Game. Sponsor/Promoter is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected Scratchee Card requests or allocations.
There are a discrete number of Scratchee Cards available for a Game, and the Entry Period will end once all Scratchee Cards for that Game have been distributed.
In the event of a dispute as to any registration of an Account, the authorized account holder of the email address used to register the Account will be deemed to be the Participant. The “authorized account holder” is the natural person assigned the email address by an internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.
Use of any automated or other system(s) to Participate, to acquire Scratchee Cards or play the Games is prohibited and will result in disqualification and loss of eligibility to Participate in the Games.
Scratchee Cards, regardless of the method by which they were obtained, are only valid during the Entry Period listed in the applicable Scratchee Card Game Details, and for thirty (30) days thereafter.
Scratchee Cards may be forfeited if a Participant’s Account is deactivated for any reason.
GAME PLAY:
To play the Games, go to the Website, sign in to your Account, navigate to your ‘My Scratchees’ and select ‘Start Scratching’. Virtually scratch the Scratchee Card and an immediate onscreen message will notify you whether you are a potential winner of a prize in the applicable Game.
Scratchee Cards for a particular Game must be played within five days of the end date of that Game. Any Unplayed Scratchees after these periods will be void and not eligible to be played in the Game or to win a prize in the Game.
Sponsor’s/Promoter’s decisions as to the administration and operation of the Games, and the amount of winnings are final and binding.
Sponsor/Promoter reserves the right to change the prize win rates and odds of any Game at any time. A Participant can see the actual and any amended details by access the Game Details. It is the Participant’s responsibility to check the prize win rate on each occasion before they participate.
VALIDATION:
POTENTIAL GAME WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR/PROMOTER (IN ANY MANNER IT MAY CHOOSE) AND THE DECISIONS OF SPONSOR/PROMOTER ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE GAMES. A PARTICIPANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE ONLINE SCREEN INDICATED THEY ARE, UNLESS AND UNTIL THE PARTICIPANT’S ELIGIBILITY AND THE POTNETIAL WINNING PLAY HAS BEEN VERIFIED AND THE PARTICIPANT HAS FULLY COMPLIED WITH THESE RULES AND BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR/PROMOTER WILL NOT ACCEPT SCREENSHOTS OR OTHER PURPORTED EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS.
Potential prize winners must comply with these Rules and winning is contingent upon fulfilling all requirements.
Potential prize winners may be required to complete and sign an Affidavit/Declaration of Eligibility and a Prize/Publicity Release (where lawful) within the time requested by Sponsor. Prize winners may also be required to sign and return completed tax forms to Sponsor upon request. A potential winner may also be required to complete an extended verification which may including supplying Sponsor a copy of their government-issued identification and complete additional required verification. Failure to return these documents within the time requested will result in forfeiture of any prize.
If a potential winner cannot be contacted, fails to properly execute and return the Affidavit/Declaration of Eligibility and a Prize/Publicity Release within the required time period (if applicable), fails to comply with these Rules, or if the prize or prize notification is returned as undeliverable, that potential winner forfeits the prize.
If a potential winner of a Game prize is disqualified for any reason, Sponsor/Promoter may, in its sole discretion, reseed the prize back into the Game.
PRIZES/ODDS OF WINNING:
The number and value, and any other specific prize details, for prizes available in a Game and the odds of winning a prize will be disclosed in the applicable Game Details. Prizes, that are in dollar increments and not in Website credits, can be redeemed for real prizes. Only prizes won through Game play provide the opportunity to redeem winnings for real prizes. Prizes provided in dollar values, and not in Game credits, can be redeemed for a prize with value being equivalent to $1 USD.
All expenses and taxes associated with the prize are the responsibility of the Winners.
No substitution or transfer of a prize will be permitted, except by the Sponsor, who reserves the right at its sole discretion to substitute a prize with another prize of equal or greater value. Sponsor/Promoter reserves the right to substitute the listed prize of equal or greater value for any reason owing to circumstances outside Sponsor’s/Promoter’s reasonable control.
Once you have been validated as an official prize winner, the prize will be credited in your Account. Prize redemption instructions will be provided in your Account. Unless Sponsor/Promoter requires otherwise, any dollar amount shown on the Account may only be redeemed if it is provided as a prize in a Game. Otherwise stated, any dollar values deposited onto the platform to purchase discount hub access cannot later be redeemed via gift card as explained below.
When a Participant has chosen to redeem prizes won in Game play for cash, the payment will be made in USD via gift card, to be delivered via email. Sponsor/Promoter reserves the right to require the use of the same payment method for redemption of prizes as was used to purchase discount hub access, or a specific payment method at Sponsor/Promoter’s discretion.
Sponsor/Promoter will only process a prize redemption if the redeemed value of the prize is $20 USD or more. Consequently, a Participant’s Account must have a withdrawal balance of at least $20 USD before requesting a prize redemption.
TO BE ELIGIBLE FOR A PRIZE OR A PRIZE REDEMPTION:
A PARTICIPANT MUST BE A LEGAL RESIDENT OF THE UNITED STATES (INCLUDING THE DISTRICT OF COLUMIA BUT EXCLUDING THE OUTLYING TERRITORIES AND THE STATES OF FLORIDA, LOUISIANA, MICHIGAN, MONTANA, NEVADA, NEW JERSEY, NEW YORK, AND WASHINGTON); AND
THE PARTICIPANT’S DETAILS MUST MATCH THOSE OF THE PARTICIPANT’S ACCOUNT.
Sponsor/Promoter reserves the right, in its sole discretion, to limit a Participant’s redemption to $1,000 USD per day. No more than the stated number of prizes will be awarded.
Sponsor/Promoter is not responsible for any foreign exchange transaction fees, charges or related costs that may be incurred as a result of, or in relation to, a prize redemption, including but not limited to any losses or additional costs arising from foreign exchange fluctuations.
Prize winners will be notified by/through the Scratchee Card’s result page.
Participants will be notified that their request for redemption is received by … . Participants will be notified of receipt of their prize by …. .
PUBLICITY:
Except where prohibited, participation in the Games constitutes each Participant’s consent to Sponsor’s/Promoter’s and its agents’ use of the Participants name, likeness, photograph, voice, opinions, and/or hometown and state/territory for promotional purposes in ant media worldwide, without further payment, notice, or consideration.
GENERAL CONDITIONS:
Only the number and value of prizes as stated in the Game Details are available to be awarded in that Game. Any unclaimed prizes will not be awarded. If due to printing, electronic or other error, there are more claims for any particular prize(s) than available as stated in the Game Details, these prizes will be awarded by random drawing from among all potential claimants with valid claims for that prize(s).
If for any reason the operation or administration of a Game is impaired or incapable of running as planned for any reason, including but not limited to (i) infection by computer virus, bugs, (ii) tampering, unauthorized intervention, (iii) fraud, (iv) technical failures, or (v) any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Game, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Game in whole or in part, at any time, without notice and award the available prizes using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable and best conforms to the spirit of these Official Rules.
Sponsor reserves the right, at its sole discretion, to disqualify any individual deemed to be tampering or attempting to tamper with the entry process or the operation of a Game or Sponsor’s Websites; or acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE; THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
In all other cases, the Sponsor/Promoter reserves the right to cancel, suspend, and/or modify the Games. Any notice regarding cancellation, suspension, and/or modification will be posted in the Game Details or on the Website.
In the event of modifying the Game, these Game Rules, or the Game Details, a Participant’s continued enrolment and/or participation in the Games constitutes acceptance of the modified terms. If you do not agree to the amended Game Rules, you may not participate in such promotional game play.
In the event of a dispute as to the identity of an entrant or winner, the entrant will be declared by the authorized account holder of the email address associated with Account. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
Any Participant posting or seen to be posting comments on Sponsor’s/Promoter’s Facebook, Instagram, Trustpilot or TikTok page/s or elsewhere during the game that are considered bullying, spiteful or upsetting to other Participants, players, and fans of DGR Media LLC or directly aimed at the Sponsor/Promoter, will have their comments removed and will be disqualified from the Games. The Sponsor/Promoter reserves the right to alert Facebook, Instagram, Trustpilot or TikTok to any such behavior.
ENTRY CONDITIONS, RELEASE, AND LIMITATIONS OF LIABILITY:
By participating in a Game and/or accepting any prize, you agree to:
Comply with and be bound by: (i) The Terms; (ii) These Rules in including applicable Game Details; and (iii) The decisions of the Sponsor/Promoter which are binding and final; and
Release and hold harmless the the Sponsor/Promoter and its parent, subsidiary, and affiliated companies, and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Games, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the Released Parties) from and against any claim or cause of action, expenses, and liability arising out of participation in the Game or receipt or use of any prize, including, but not limited to: (i) any technical errors that may prevent you from playing the Game or using or accessing a Scratchee Card; (ii) unauthorized human intervention in the Game; (iii) printing errors; (iv) errors in the administration of the Game or the processing of entries; or (v) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the Game or receipt of any prize. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to your or any other person's computer or phone relating to or resulting from participation in this Game or downloading any materials related to the Game or your Account.
Indemnify, defend, and hold harmless the Sponsor/Promoter from and against any and all claims, expenses, liabilities (including reasonable attorneys/legal fees) arising out of or relating to a Participant’s participation or inability to participate in the Games and/or Participant’s acceptance, use of misuse of prizes.
You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Game, and in no event shall the Released Parties be liable for attorney fees. You hereby waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
If for any reason a Participant’s winning play is confirmed to have been erroneously delated, lost, or otherwise destroyed or corrupted, Participant’s sole remedy is replacement by Sponsor/Promoter of an equivalent amount of prize winnings.
Except as expressly provided above, IN NO EVENT WILL RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS GAME OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF A PRIZE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTIAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY.
EACH ENTRANT UNDERSTANDS AND AGREES THAT ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY OF THE USA ARE HEREBY EXPRESSLY WAIVED BY HIM/HER. SECTION 1542 READS AS FOLLOWS:
“A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”
DISPUTES:
All disputes are subject to the dispute resolution provision in our Terms https://help.scratchee.com/terms-and-conditions.
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Game Rules, or the rights and obligations of the Participant and Sponsor/Promoter in connection with the Games, are governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the State of California.
SEVERABILITY:
The invalidity or unenforceability of any provision of the Official Rules will not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, the other provisions will remain in effect and will be construed as if the invalid or unenforceable provision were not contained herein.
MISCELLANEOUS:
The Official Rules contain the full and complete understanding with respect to the Game and supersede all prior and contemporaneous agreements, representations, and understandings, whether oral or written. The headings herein are for convenience only, do not constitute a part of the Official Rules, and shall not be deemed to limit or affect any of the provisions hereof. No amendment to, or waiver of, any provision of the Official Rules shall be effective unless in writing and signed by Sponsor. The waiver by Sponsor of any provision of the Official Rules shall not constitute a waiver of any other provision herein. The rights and obligations hereunder may not be assigned by you, whether by operation of law or otherwise, without the prior written consent of Sponsor, and any attempted assignment in violation of the foregoing shall be null and void. The Official Rules shall be binding upon, and inure to the benefit of, the permitted successors and assigns of Sponsor and entrants.
WINNERS LIST REQUEST:
To request confirmation of the first name, last initial, city, and state of residence of a Winner of any major prize in a Game, please send a self-addressed, stamped business size envelope, by the end date of that Game to DGR Media LLC, 377 Valley Road 1414, Clifton, NJ 07013, including identification of the specific Game.
